Thanks for taking the time to file this bug!  I actually filed a similar Radar
bug with Apple about this a while ago:

<rdar://problem/4673590> Cmd-T opens a new browser window when sheet is
displayed in front window

It was closed as "Behaves correctly" with the following explanation:

"This behavior is intentional. When the frontmost window has a sheet up, the
window is in a blocked state and can't/shouldn't be modified. Logic elsewhere
treats New Tab like New Window if there's no frontmost browser window or if it
isn't available for a new tab (which it isn't if it has a sheet up).

"Please know that it would violate the meaning of modal sheets if a new tab
were added to the window. The other alternative would be to disable "New Tab"
when the frontmost browser window has a sheet up, but the current behavior is
deliberately slightly more forgiving."
