In searching through the depths of the W3C's site I found two documents explaining that it the csswg 
policy to encode their test suites as UFT-8 (http://www.w3.org/Style/CSS/Test/guidelines.html#encoding) 
and that, at least for xhtml it is their policy to omit the '<?xml version="1.0" encoding="utf-8"?>' PI 
(http://www.w3.org/Style/CSS/Test/testsuitedocumentation.html#testthetech).  Of course that doesn't 
mean that a meta tag would against the rules.

Also, while not fixing this problem, there is an updated version of this test suite on Ian Hixie's site at 
http://www.hixie.ch/tests/evil/css/css21/ .  While not official yet, it is at least more thorough containing 
223 more tests by my count, in matching html and xhtml varieties.
